Terms and Conditions for The New Me Weightloss Retreat and Personal Training Studio

Please note that the terms and conditions listed here are ‘extracts’ of the contract required by all participants of 'The New Me'

1.             I am willing to submit medical information to 'The New Me' and to submit to a medical examination and background check, in order to comply to 'The New Me' health and safety screening.

2.             I hereby authorise an appropriately qualified person or entity as designated by 'The New Me' to conduct physical examination of me as required by 'The New Me'. I further authorise the individuals conducting such examinations of me to disclose to 'The New Me' and their representatives all information about me obtained in connection with such examinations, and authorise 'The New Me' to utilise such information in research and the process of accepting guests for the Program.

3.             I agree not to disclose to any third party information relating to the Program or the affairs of 'The New Me' (or any assigned company) which may come to my knowledge during or in connection with my participation in the Program.

4.             I agree that I will not publicise, copy, redistribute or discuss with any third party without prior written consent from 'The New Me' any information relating to the Program, my participation in the Program, handouts or the format of the program any of the Adro Health Team or any other guests in the Program nor any other information which may come to my attention relating to 'The New Me' or otherwise connected to the Program save for such information which is already public knowledge. Should I be contacted by a member of the press at any time I agree to refer them to 'The New Me' or such person as 'The New Me' may nominate. Email thenewmeadmin@bigpond.com

Fees and Conditions:

All rates and charges quoted are subject to change with notice. 'The New Me' reserves the right to modify any pricing structure at its own discretion. Prices are subject to change annually to cover inflation.

All fees are due no later than 1 week (7days) prior to attending 'The New Me'.

All payments are to be made by any of the available means of funds transfer as no cash will be accepted by 'The New Me' at any time.

Where indicated fees may or may not include the necessary GST.

Rules:

'The New Me' ….

1.     Is a cigarette; alcohol and drug free zone in the facility and on all property used by 'The New Me'. This includes the inappropriate use of prescription medication.

2.     Will not tolerate inappropriate or violent behavior or inappropriate conduct towards staff or other guest either physically or verbally.

3.     Will not tolerate any behavior that will endanger mine or any other person’s life or person in any way.

4.     Will not tolerate dishonest behavior or acts.

5.     Will not tolerate public nudity.

6.     Does not encourage foul or vulgar language or conversations.

7.     I understand that 'The New Me' runs a structured program and I will participate in the complete 'The New Me' program at all times to the best of my ability, and will not promote or cause disruption to other guests who are participating in the program should I chose to not participate.

Abusing or breach of these Rules will not be tolerated and will result in your removal from the program.

Refund Policy:

a)     All guests must purchase a starter pack to secure their position in the program. This is used as a deposit but is not a part of the program fee.

b)    The starter pack is available for collection on arrival at 'The New Me' only.

c)     After the application form has been distributed if a refund of the starter pack purchase is necessary $50 will be with held for miscellaneous administration charges;

d)    If the application form is submitted and the client is deemed unfit to participate the price of the starter pack will be refunded, $50 will be with held for miscellaneous adminstration charges.

e)     Fees and charges may apply for date changes or other changes made where the client is responsible for; or request the changes.

f)     If the application is successful the starter pack is no longer refundable.

g)    If an applicant chooses to withdraw from the program within 7days prior to the booked intake day 'The New Me' will only refund up to 50% of the payment of the program as the reserved position may be difficult to re sell.

h)     No refund will be given if the client chooses to leave 'The New Me' or is removed from the program prior to the booked length of stay. If the client chooses to leave 'The New Me' early they do so at their own discretion and forfeit any pre paid time (in lieu) at 'The New Me'. 'The New Me' may use its discretion to decide if a guest who leaves the program is able to return.

i)      'The New Me' in no way guarantees any weight loss and results may vary per individual.

I hereby represent, warrant, acknowledge and agree that:

a.     I have read and I meet and agree to be bound by the eligibility requirements;

b.    I will abide by the rules, regulations, terms and conditions (the “Rules”) of the Program and in the event of any event, activity, or the program as a whole complete program. If I do not than I accept that 'The New Me' has a 3 strikes and you’re out policy and I may be ejected from the program forfeiting any right to a refund.

c.     I have completed this application and will complete all forms associated with the Program honestly and accurately and I agree that the answers and information I will supply in such forms and otherwise to 'The New Me' will be in no way misleading. I further more acknowledge that 'The New Me' reserves the right exercisable at any time at its sole discretion to disqualify and remove me from the Program should I at any stage supply untruthful, inaccurate or misleading personal mainly medical details or information, break the accommodation Rules or otherwise be in breach of the terms contained herein. Accordingly, I understand that if any of the information in this application is found to be false or incomplete, this will be grounds for dismissal or disqualification from the Program and by being disqualified I waiver my rights to a refund of any part.

d.    Even if I meet the eligibility requirements, 'The New Me' has no obligation to accept me, and/or select me as a guest;

e.     All decisions by 'The New Me' concerning selection of the guests is final and not subject to challenge or appeal;
